TIM prende atto della decisione assunta oggi dall’Autorità Garante della Concorrenza e del Mercato (AGCM) per comportamenti risalenti ad anni fa nei confronti della quale presenterà ricorso alla giustizia amministrativa.
Il provvedimento dell’AGCM suscita inoltre perplessità, anche perché le presunte condotte anticompetitive di TIM vengono valutate in maniera del tutto diversa dal Regolatore del settore (AGCOM).
Infatti, AGCOM si è in più occasioni occupata dei temi trattati nell’istruttoria, adottando regolamentazioni specifiche su gran parte delle fattispecie oggetto del provvedimento.
L’Autorità Antitrust ha comunque valutato positivamente il fatto che TIM ha immediatamente bloccato gli investimenti nelle Aree Bianche, non ha mai commercializzato i propri servizi ultrabroadband e ha rinunciato a tutti i contenziosi in essere sulle gare Infratel coinvolgenti Open Fiber.
Inoltre, l’Autorità ha riconosciuto il valore delle importanti iniziative realizzate recentemente da TIM per favorire lo sviluppo della concorrenza, anche infrastrutturale, nel mercato della banda ultralarga: il lancio di un piano per la realizzazione di reti in fibra in 39 città, invitando i concorrenti interessati al coinvestimento, per ridurre costi e tempi di completamento, e l’introduzione di nuove e più convenienti offerte per i concorrenti per la realizzazione di reti proprietarie in fibra.
Si ricorda inoltre che TIM, a fronte dei rilievi mossi dall’AGCM, ha dimostrato con dati di fatto e analisi di terzi indipendenti che le azioni contestate non hanno prodotto alcun effetto distorsivo sul mercato.
La principale contestazione oggetto della decisione fa riferimento a un progetto di investimento nelle aree a fallimento di mercato (cosiddette Aree Bianche), considerato da AGCM abusivo nei confronti di Open Fiber che, in tali aree, dovrebbe costruire con soldi pubblici un’infrastruttura in fibra che arrivi nelle case (così come richiamato dall’AGCM), cosa che invece non è avvenuta come anche evidenziato in diverse sedi istituzionali.
In conclusione, desta stupore ricevere una sanzione per aver ipotizzato di investire risorse private nell’ammodernamento del Paese per il conseguimento degli obiettivi dell’Agenda Digitale, pur adeguando puntualmente la propria offerta alle prescrizioni regolamentari.
Purtroppo, gli unici danneggiati in questa vicenda sono gli abitanti delle Aree Bianche che ancora non sono collegati alla rete in fibra.

TIM: SANCTIONED UNDULY, WILL APPEAL

TIM acknowledges the decision taken today by the Italian Antitrust Authority (AGCM) in relation to actions dating back years and will appeal against it in administrative court.
AGCM’s decision also raises concerns, not least because the Italian telecoms watchdog AGCOM has taken an entirely different view of TIM’s alleged anti-competitive behaviour.
In fact, AGCOM has on several occasions dealt with the issues discussed in the preliminary investigation, adopting specific regulations on most of the cases covered by the provision.
However, AGCM has welcomed the fact that TIM immediately halted the investments in the ‘White Areas’, never marketed its ultrabroadband services and has waived all existing claims on the Infratel tenders involving Open Fiber.
Moreover, AGCM has recognised the value of TIM’s recent major initiatives to foster the development of competition in the ultrabroadband market, including for infrastructure: the launch of a plan to build fibre networks in 39 cities, inviting co-investment from competitors in order to reduce costs and time to completion, and the introduction of new and cheaper offers for competitors to build proprietary fibre networks.
Furthermore, in light of AGCM’s evaluations, TIM has proven through facts and independent third-party analysis that its alleged actions had no distortive effects on the market.
The main objection of the decision refers to an investment project in market failure areas (so-called White Areas), considered by AGCM to be abusive towards Open Fiber which should build a fibre infrastructure to the homes with public resources (as recalled by the AGCM), which though did not take place as also highlighted by several institutional offices.
In conclusion, TIM is surprised to have been sanctioned for planning to invest private funds in the modernisation of the country to achieve the objectives of the Digital Agenda, while having promptly adapted its proposition to meet regulatory requirements.
Regrettably, the only ones damaged in this story are the residents of the White Areas who are not yet connected to the fibre network.
